Bài viết nghiên cứu về đất xây dựng công trình ngầm thông qua phân tích các chủ trương, chính sách của Đảng và Nhà nước, đồng thời đánh giá quy định pháp luật Việt Nam và một số quốc gia trên thế giới. Qua đó, kiến nghị xây dựng khung pháp lý điều chỉnh đất xây dựng công trình ngầm ở Việt Nam, như: (i) công nhận quyền sử dụng đất xây dựng công trình ngầm
(ii) cấp Giấy chứng nhận quyền sử dụng đất đối với đất xây dựng công trình ngầm
(iii) phân tầng và đặt ra giới hạn độ sâu ngầm
(iv) kế thừa và phát triển chính sách tạo điều kiện và phát huy nguồn lực nhằm đẩy mạnh quá trình ngầm hóa đô thị một cách bền vững, an toàn và bảo vệ môi trường.This paper analyzed underground construction land by analyzing the orientations and policies of the Communist Party of Vietnam and the Government of Vietnam. The paper also assessed Vietnam’s current related regulations and those of several countries in the world. Based on the paper’s findings, some recommendations were made to strengthen Vietnam’s legal framework for underground construction land. These recommendations include recognizing the rights to use underground construction land, issuing the certificate of land use right for underground construction land, zoning and setting depth limits for underground construction, inheriting and developing policies to cre-ate conditions, and utilizing resources to enhance sustainable, safe, and environmentally protective urban underground development.
