Trợ cấp thất nghiệp là một trong bốn chế độ mà người lao động được hưởng khi tham gia bảo hiểm thất nghiệp theo quy định của Luật Việc làm (LVL) năm 2013. Hơn 10 năm thực hiện, chế định trợ cấp thất nghiệp tại LVL năm 2013 đã hỗ trợ rất nhiều cho người lao động khi bị mất việc làm, tuy nhiên, vẫn còn một số bất cập trong quá trình triển khai trên thực tế. Theo Chương trình xây dựng luật, pháp lệnh năm 2024, tại kỳ họp thứ 8 (tháng 10/2024), Quốc hội sẽ cho ý kiến về LVL (sửa đổi). Bài viết đề cập các quy định của LVL năm 2013 về trợ cấp thất nghiệp, chỉ ra những hạn chế, tồn tại trong thực tiễn thực hiện, trên cơ sở đó đề xuất một số kiến nghị nhằm hoàn thiện pháp luật về trợ cấp thất nghiệp tại Dự thảo LVL (sửa đổi)Unemployment benefit is one of four regimes that employees are entitled to when participating in unemployment insurance according to the provisions of the 2013 Employment Law. For more than 10 years of implementation, the unemployment benefit institution in the Employment Law in 2013 has greatly supported employees when they lose their jobs. However, there are still some inadequacies in practical implementation process. According to the Law Development Program, the ordinance in 2024, the National Assembly, at the 8th session (October 2024), will comment on the Employment Law (amended). The article mentions provisions of the 2013 Employment Law on unemployment benefits, pointing out limitations and shortcomings in practice to propose a number of recommendations to complete the law on unemployment benefits in the draft Law on Employment (amended).
