Current trial practice shows that the application of legal bases to resolve requests to change the person directly raising children after divorce still has many obstacles and inadequacies. This article researches and clarifies some issues of theory about the right to request a change in the person directly raising children after divorce and proposes solutions to improve the effectiveness of law application to ensure the legal and legitimate rights of litigants.Thực tiễn xét xử hiện nay cho thấy, việc áp dụng các căn cứ pháp lý giải quyết yêu cầu thay đổi người trực tiếp nuôi con sau khi ly hôn còn nhiều vướng mắc, bất cập. Bài viết nghiên cứu, làm rõ một số vấn đề lý luận về quyền yêu cầu thay đổi người trực tiếp nuôi con sau khi ly hôn và để xuất giải pháp nâng cao hiệu quả áp dụng pháp luật, nhằm đảm bảo quyền lợi hợp pháp, chính đáng của các bên đương sự.
