After eight years of implementation, the 2014 Law on Organization of People’s Courts has revealed a number of shortcomings, problems, inadequacies and unreasonableness. Among the 08 major contents to be amended, the content on “awareness of the position and role of the Court as a “judicial agency, exercising judicial power” and the full determination of functions, tasks, and powers of the Court” is one of the issues receiving attention and comments of many stakeholders. This shows that in the context of needing to promote judicial reform, the requirement of perfecting legal regulations to be the basis for building a professional, modern Court, ensuring the independence of the Court to build Building and perfecting the Vietnamese socialist rule-of-law state is a key content that needs to be studied.Sau tám năm thi hành, Luật Tổ chức Tòa án nhân dân năm 2014 đã cho thấy một số tồn tại, vướng mắc, bất cập và chưa hợp lý. Trong 08 nội dung lớn cần sửa đổi thì nội dung về “nhận thức vị trí, vai trò của Tòa án là “cơ quan xét xử, thực hiện quyền tư pháp” và việc xác định đầy đủ chức năng, nhiệm vụ, quyền hạn của Tòa án là một trong những vấn đề nhận được sự quan tâm góp ý của nhiều bên liên quan. Điều đó cho thấy, trong bối cảnh cần đẩy mạnh cải cách tư pháp, yêu cầu của việc hoàn thiện quy chế pháp lý làm cơ sở để xây dựng Tòa án chuyên nghiệp, hiện đại, bảo đảm tính độc lập của Tòa án để xây dựng, hoàn thiện Nhà nước pháp quyền xã hội chủ nghĩa Việt Nam là nội dung trọng tâm cần được nghiên cứu.
