The position, functions, tasks, and powers of the Court are always fundamental issues when developing legal regulations on the organization of the Court, being important in almost all organizational issues and operation of the Court. The fifth Draft of the Law on Organization of People’s Courts (amended) has many amendments, supplements or has completely new content compared to the Law on Organization of People’s Courts in 2014. This article researches, analyzes, comments and makes suggestions on some basic contents about the position, functions, tasks, and powers of the Court in the Draft of the Law on Organization of People’s Courts (amended).Vị trí, chức năng, nhiệm vụ, quyền hạn của Tòa án luôn là những vấn đề nền tảng khi xây dựng các quy định pháp luật về tổ chức Tòa án, có ý nghĩa quan trọng trong hầu hết tất cả các vấn đề về tổ chức và hoạt động của Tòa án. Dự thảo Luật Tổ chức Tòa án nhân dân (sửa đổi) có nhiều nội dung sửa đổi, bổ sung hoặc có nội dung hoàn toàn mới so với Luật Tổ chức Tòa án nhân dân năm 2014. Bài viết nghiên cứu, phân tích, bình luận và đưa ra đề xuất hoàn thiện Dự thảo Luật về vị trí, chức năng, nhiệm vụ, quyền hạn của Tòa án.
