Correctly determining the legal relationship in dispute is one of the basic legal conditions for resolving a civil case. However, in practical application of law, there are many civil cases in which there is confusion in the specific determination of the legal relationship in dispute, causing the consequence that the resolution of the case fails to ensure compliance with the provisions of law and causes negative affect to the legal rights and interests of litigants in civil cases. In this article, the author presents a commentary on how to determine the disputed legal relationship in a civil judgment on “Claim for compensation for non-contractual damages” between the plaintiffs named Mr. Dinh Hong V and the defendant named Ms. Nguyen Thi Thanh H in the judgment No. 04/2020/DS-ST dated May 28, 2021 of the People’s Court of district T, province P. F-rom there, the author points out the lessons to determine the legal relationship of the dispute in a civil judgment. F-rom there, lessons can be drawn to determine the legal relations of disputes in a civil judgment, to determine lawsuit claims, and some notes when formulating judgments in the judgment of resolving civil cases.Xác định đúng quan hệ pháp luật tranh chấp là một trong những điều kiện pháp lý cơ bản để giải quyết mộtt vụ án dân sự. Tuy nhiên, trên thực tế áp dụng pháp luật, có rất nhiều vụ án dân sự mà việc xác định cụ thể quan hệ pháp luật tranh chấp còn có sự nhầm lẫn, khiến cho việc giải quyết vụ án không đảm bảo đúng quy định của pháp luật, từ đó ảnh hưởng nhiều đến quyền, lợi ích hợp pháp của các đương sự trong vụ án dân sự. Trong bài viết, tác giả trình bày quan điểm bình luận về cách xác định quan hệ pháp luật tranh chấp trong một bản án dân sự về việc “Yêu cầu bồi thường thiệt hại ngoài hợp đồng” giữa nguyên đơn là anh Đinh Hồng V và bị đơn là chị Nguyễn Thị Thanh H theo Bản án số 04/2020/DS-ST ngày 28/05/2021 của Tòa án nhân dân huyện T, tỉnh P2. Từ đó, rút ra bài học kinh nghiệm để xác định quan hệ pháp luật tranh chấp trong một bản án dân sự, xác định yêu cầu khởi kiện và một số lưu ý khi xây dựng bản án trong thực tiễn giải quyết các vụ án dân sự hiện nay.
