The practical application of the law regarding exemption f-rom criminal liability, as stipulated in clause 3, Article 29 of the 2015 Criminal Code (amended and supplemented in 2017), reveals numerous shortcomings, such as conditions for application, timing of application, authority to apply, and legal consequences. To ensure uniform, consistent, and fair application that targets the proper subjects effectively, in-depth research on the theoretical foundations and practical implementation is necessary. Based on an analysis of the challenges and shortcomings, this article proposes several solutions to improve the legal framework for exemption f-rom criminal liability in Vietnam shortly.Thực tiễn áp dụng pháp luật về miễn trách nhiệm hình sự được quy định tại khoản 3 Điều 29 Bộ luật Hình sự năm 2015, (sửa đổi, bổ sung năm 2017), còn bộc lộ nhiều bất cập, như: điều kiện áp dụng, thời điểm áp dụng, thẩm quyền áp dụng, hậu quả pháp lý. Để bảo đảm áp dụng đồng bộ, thống nhất, đúng đối tượng, công bằng và hiệu quả, cần nghiên cứu chuyên sâu về cơ sở lý luận và thực tiễn áp dụng. Trên cơ sở phân tích những khó khăn, bất cập, bài viết đề xuất, kiến nghị một số giải pháp nhằm hoàn thiện pháp luật về miễn trách nhiệm hình sự Việt Nam trong thời gian tới.
