Bài viết phân tích thực trạng, xu hướng và quan điểm của các cơ quan nhân quyền Liên hợp quốc về hình phạt tử hình nói chung, về phạm vi áp dụng của hình phạt này nói riêng. Trên cơ sở đó, tác giả so sánh và đề xuất sửa đổi một số quy định của Bộ luật Hình sự hiện hành theo hướng giảm sô tội phạm có thể áp dụng hình phạt tử hình đế phù hợp với thực tế trong nước, xu thế quốc tế và khuyến nghị của các cơ quan nhân quyền Liên hợp quốc.This article analyzes the status, trends and views of the United Nations human rights agencies on the death penalty in general, the scope of application of this penalty in particular. On that basis, the author compares and proposes to amend some of the provisions of the current Criminal Code in the direction of reducing the number of crimes may be applied death penalty in order to suit the domestic practice, the international trend and recommendations of the United Nations human rights agencies.
