In practice, many provisions related to the settlement of cases of property loan contract disputes are not really suitable, there are still obstacles and inadequacies regarding the subjects, forms of contracts, obligations to prove the payment when performing the contracts, loan interest rates,... leading to inconsistent application of the law, meanwhile, supervising settlement of cases of property loan contract disputes has not had specific guidance in the whole sector.Thực tiễn cho thấy, nhiều quy định liên quan đến việc giải quyết các vụ án tranh chấp hợp đồng vay tài sản chưa thực sự phù hợp, vẫn còn vướng mắc, bất cập về đối tượng, hình thức hợp đồng, nghĩa vụ chứng minh việc giao tiền khi thực hiện hợp đồng, lãi suất vay... dẫn đến việc áp dụng pháp luật chưa thống nhất, trong khi đó, hoạt động kiểm sát việc giải quyết các vụ án tranh chấp hợp đồng vay tài sản chưa có hướng dẫn cụ thể trong toàn ngành.
