Quan niệm phổ biến ở nhiều quốc gia ngày nay trong cả hệ thống pháp luật Common law hay Civil law đều cho rằng, Tòa án không phải là cơ quan áp dụng pháp luật thuần túy mà là cơ quan thực hiện nhiệm vụ đảm bảo công lý. Vì vậy, Tòa án không thể từ chối giải quyết vụ việc vì lý do không có pháp luật quy định. Điều này có nghĩa Tòa án được trao cho quyền năng sáng tạo pháp luật hay tạo lập án lệ. Việt Nam đã cụ thể thẩm quyền tạo lập án lệ của các chủ thể trong một số văn bản pháp luật. Tuy nhiên quy định pháp luật vẫn còn những hạn chế. Ở bài viết này, tác giả tập trung vào phân tích quy định pháp luật và thực tiễn thực hiện, từ đó đưa ra một số giải pháp về thẩm quyền tạo lập án lệ của thẩm phán và Tòa án nhằm nâng cao hơn chất lượng nguồn án lệ, vai trò của án lệ trong việc giải quyết các vụ việc dân sự ở Việt Nam hiện nay.The common concept in many countries today in both the Common law and Civil law legal systems is that the court is not a pure law enforcement agency but an agency that performs the task of ensuring justice. Therefore, the court cannot refuse to resolve a case because there is no legal provision. This means that the court is given the power to cre-ate law or cre-ate precedents. Vietnam has specified the authority to cre-ate precedents of subjects in a number of legal documents. However, legal provisions still have limitations. In this article, the author focuses on analyzing legal provisions and implementation practices, thereby proposing a number of solutions on the authority to cre-ate precedents of judges and courts to improve the quality of precedent sources and the role of precedents in resolving civil cases in Vietnam today
