The crime of using computer networks, telecommunications networks, and electronic means to commit property appropriation is prescribed in Article 290 of the Penal Code (CrPC). It is a crime of property appropriation, but this crime has exclusionary differences (right in the Law) compared to the crime of property theft and the crime of fraudulent appropriation of property specified in Articles 173 and 174 of the Penal Code. Therefore, in addition to the common points, the conduct of proceedings, especially the trial of the case of using computer networks, telecommunications networks, and electronic means to commit property appropriation has specific features of content as well as proceedings. This article shares some skills and experiences in judging cases of this crime.Tội sử dụng mạng máy tính, mạng viễn thông, phương tiện điện tử thực hiện hành vi chiếm đoạt tài sản được quy định tại Điều 290 Bộ luật Hình sự (BLHS). Là tội chiếm đoạt tài sản nhưng cấu thành tội phạm này có những điểm khác biệt mang tính loại trừ (ngay trong Điều luật) so với tội trộm cắp tài sản, tội lừa đảo chiếm đoạt tài sản quy định tại Điều 173 và Điều 174 BLHS. Vì vậy, ngoài các điểm chung, việc tiến hành tố tụng, đặc biệt là xét xử đối với vụ án về tội sử dụng mạng máy tính, mạng viễn thông, phương tiện điện tử thực hiện hành vi chiếm đoạt tài sản cũng có những điểm đặc thù về nội dung cũng như về thủ tục tố tụng.
