Việc khởi tố theo yêu cầu của bị hại đối với một số tội thuộc nhóm tội xâm phạm tình dục cũng cần sửa đổi theo hướng không cần khởi tố theo yêu cầu của bị hại, mà các cơ quan tiến hành tố tụng có thẩm quyền tiến hành khởi tố vụ án hình sự ngay khi có đủ căn cứ.
