Trong phạm vi bài viết, tác giả sẽ tập trung trình bày về các quy định của pháp luật về đặt cọc, phạt cọc cũng như những vướng mắc khi áp dụng chế tài phạt cọc, đồng thời kiến nghị một số giải pháp nhằm hạn chê những vướng măc phát sinh trong tưcmg lai.Deposit is a measure to secure the performance of obligations, which appeared very early in the Vietnamese civil legal system to ensure the implementation of obligations of the parties involved in the transaction. Within the scope of this article, the authors will focus on presenting regulations on the deposit, deposit penalty, and problems when applying the deposit penalty. At the same time, the authors propose some solutions to limit the inadequacies arising in the future.
