The current legal situation on protecting the rights of third parties who sincerely establish rights other than property when a civil transaction is invalid has many shortcomings. Trong phạm vi bài viết này, tác giả phân tích vê những vân để lý luận bảo vệ quyển lợi người thứ ba ngay tình khi giao dịch vô hiệu gồm giao dịch vô hiệu gôm giao dịch vô hiệu và dấu hiệu nhận diện người thứ ba ngay tình xác lập quyền khác với tài sản khi giao dịch vô hiệu, đồng thời phân tích thực trạng pháp luật về vấn đề này, từ đó đề xuât một số kiến nghị nhằm hoàn thiện các quy định pháp luật.
