During the process of resolving disputes by arbitration, the parties can agree to choose the language, applicable law, procedures, arbitrators, etc. However, different legal systems may regulate different aspects of the arbitration process. Hence, it is necessary to clarify the terms of the applicable law. This paper introduced the principles of applicable law to arbitration proceedings, the content of the dispute, and the arbitration agreement.Trong quá trình giải quyết tranh chấp bằng trọng tài, các bên có thể thỏa thuận lựa chọn ngôn ngữ, luật áp dụng, thủ tục, trọng tài viên... Tuy nhiên, hệ thống pháp luật khác nhau có thể điều chỉnh các khía cạnh khác nhau của quá trình trọng tài, do vậy làm rõ vấn đề “luật áp dụng” có vai trò rất quan trọng. Bài viết tập trung giới thiệu các nguyên tắc “luật áp dụng” đối với tố tụng trọng tài (TTTT), nội dung tranh chấp và thỏa thuận trọng tài.
