Mô hình doanh nghiệp xã hội đã được phổ biến rộng rãi và phát triển ở nhiều quốc gia trên thế giới nhưng những năm gần đây, doanh nghiệp xã hội ngày càng được quan tâm, tạo điều kiện phát triển tại Việt Nam, nhất là khi khái niệm các quyền và nghĩa vụ của doanh nghiệp xã hội được quy định cụ thể trong Luật Doanh nghiệp 2014 và các văn bản hướng dẫn thi hành. Tuy nhiên, thực tiễn triển khai thi hành Luật Doanh nghiệp 2014 thời gian qua cho thấy còn có sự khác nhau, vướng mắc trong việc tổ chức thực thi Luật ở các địa phương. Bài viết sẽ chỉ ra một số vướng mắc trong các quy định của pháp luật từ đó đề xuất một số kiến nghị nhằm hoàn thiện các quy định của pháp luật về doanh nghiệp xã hội.The model of social enterprises has been widely popularized and developed in many countries around the world, but in recent years, social enterprises have been increasingly paid attention to and promoted to develop in Vietnam, especially when the concept of rights and obligations of social enterprises is specified in the Enterprise Law 2014 and its instructional embedded documents. However, the actual implementation of the Enterprise Law 2014 shows that there are still differences and obstacles in organizing the implementation of the Law in localities. The article will point out some problems in the provisions of the law, thereby giving some suggestions to improve the law.
