As a specific phenomenon in the process of governing civil relationships with foreign elements, conflict between the International private Law requires the establishment of law selection principles to apply in specific situation. Provisions on the application of Closest Relationship to determine law when dealing with civil relationships with foreign elements are newly built in the 2015 Civil Code which remains no specific guidelines. The article explores the principle of Closest Relationship under international treaties and national law around the world, thereby recommends some experience, contributing to the interpretation of this principle in Vietnam.Là hiện tượng pháp lí đặc thù trong quá trình điều chỉnh quan hệ dân sự có yếu tố nước ngoài, xung đột pháp luật đặt ra yêu cầu xây dựng các nguyên tắc chọn luật để áp dụng đối với quan hệ cụ thể phát sinh. Quy định về áp dụng luật có mối liên hệ gắn bó nhất trong xác định pháp luật áp dụng đối với quan hệ dân sự có yếu tố nước ngoài là quy định mới trong Bộ luật Dân sự năm 2015 và đến nay chưa có hướng dẫn cụ thể. Bài viết tìm hiểu về nguyên tắc xác định luật có mối quan hệ mật thiết nhất theo các điều ước quốc tế và pháp luật của các quốc gia trên thế giới, trên cơ sở đó đóng góp kinh nghiệm cho việc giải thích áp dụng quy định này tại Việt Nam.
