Based on the inheritance of internal legal achievements and the reality of crime prevention in the past time, Vietnam officially recognized and stipulated the legal entity as a subject of crime as well as the prosecution of criminal liability for legal entities in the 2015 Penal Code (amended and supplemented in 2017) and the 2015 Criminal Procedure Code (amended and supplemented in 2021). Some new provisions on investigation procedures for legal entities have created an important legal basis to ensure the effectiveness of the investigation of legal entities particularly and criminal proceedings generally.Kế thừa thành tựu pháp lý của thế giới cũng như trên cơ sở thực tiễn đấu tranh phòng chống tội phạm trong thời gian qua, Việt Nam chính thức ghi nhận, quy định vấn đề pháp nhân là chủ thể của tội phạm và việc truy cứu trách nhiệm hình sự đối với pháp nhân trong Bộ luật Hình sự năm 2015 – sửa đổi, bổ sung năm 2017 (BLHS) và Bộ luật Tố tụng hình sự năm 2015 – sửa đổi, bổ sung năm 2021 (BLTTHS) hiện hành. Trong đó, một số nội dung mới về các thủ tục về điều tra đối với pháp nhân đã tạo cơ sở pháp lý quan trọng để bảo đảm hiệu quả của công tác điều tra đối với pháp nhân nói riêng và các thủ tục tố tụng hình sự nói chung.
