Luật Doanh nghiệp năm 2020 có quy định mới về thực hiện quyền của chủ doanh nghiệp tư nhân trong một số trường hợp đặc biệt tại Điều 193. Trong đó, khoản 2, khoản 3 quy định về hậu quả pháp lý khi chủ doanh nghiệp tư nhân chết được coi là điểm tích cực của Luật Doanh nghiệp năm 2020 khi đã hạn chế được nhiều tranh chấp phát sinh liên quan tới chia thừa kế, đồng thời làm rõ được “số phận” của doanh nghiệp tư nhân. Tuy nhiên, quy định này cũng còn một số bất cập nhất định cần có sự hướng dẫn và hoàn thiện.The 2020 Enterprise Law has new regulation on rights of private business owners in some special cases, in which Clauses 2 and 3 provide legal consequences when private enterprise owner dies. It has been considered as a positive point of the 2020 Enterprise Law because it has limited many disputes related to inheritance and decided the "fate" of private enterprises. However, this regulation also has remained several shortcomings that need further guidance and improvement.
