Hiến pháp Liên bang Nga hiến định: Quyền và tự do của con người là những giá trị cao đẹp nhất. Nhà nước thừa nhận, tuân thủ và bảo vệ quyền và tự do của con người và công dân. Con người có quyền tự do và bất khả xâm phạm. Việc bắt, tạm giữ, tạm giam chỉ cho phép khi có quyết định của Tòa án1. Viện kiểm sát (VKS) Liên bang Nga thực hành quyền công tố, kiểm sát việc tuân theo pháp luật trong tố tụng hình sự để buộc tội và bảo đảm cho việc buộc tội, áp dụng hình phạt đối với người bị buộc tội đúng quy định của pháp luật. Bài viết phân tích, đánh giá về thẩm quyền của Kiểm sát viên (KSV) Liên bang Nga trong giai đoạn điều tra vụ án hình sự, giúp người đọc hiểu rõ hơn về VKS và KSV Liên bang Nga - nơi có nền tư pháp tiên tiến với những đặc điểm pháp lý có nhiều nét tương đồng với Việt Nam.The Constitution of the Russian Federation regulates: Man, his rights and freedoms are the supreme value. The Procuracy of the Russian Federation prosecutes and supervises the observance of the law in criminal proceedings to charge and ensure the prosecution as well as punishments in accordance with the provisions of law. The article analyzes the competence of the Prosecutor of the Russian Federation in investigating criminal cases, then readers may have better understand the Procuracy and the Prosecutor of the Russian Federation - an advanced judicial background with some similar legal characteristics to Vietnam.
