Among the provisional emergency measures prescribed by Vietnamese law, one of the most proposed measures by many concerned parties is the Prohibition on the transfer of property rights in the cases of disputed property. To effectively and accurately apply the measure of Prohibition on the transfer of property rights in the cases of disputed property, when considering whether or not to apply the Law on the Prohibition of transferring property rights to the disputed property, the court needs to consider both subjective and objective factors. In this article, the author presents the basic legal issues related to the application of provisional emergency measures prohibiting the transfer of property rights in the cases of disputed property, including some inadequacies and recommendations to improve legal regulations.Trong số các biện pháp khẩn cấp tạm thời (BPKCTT) được quy định theo pháp luật Việt Nam thì một trong số những biện pháp được nhiều đương sự đề nghị áp dụng nhất là biện pháp cấm chuyển dịch quyền về tài sản đối với tài sản đang tranh chấp. Để áp dụng biện pháp cấm chuyển dịch quyền về tài sản đối với tài sản đang tranh chấp hiệu quả, chính xác, Tòa án cần căn cứ các điều kiện mang tính chủ quan và khách quan để xem xét quyết định áp dụng hay không áp dụng BPKCTT cấm chuyển dịch quyền về tài sản đối với tài sản đang tranh chấp. Thực tiễn áp dụng quy định pháp luật cho thấy vẫn còn tồn tại một số bất cập cần khắc phục. Do đó, việc nghiên cứu căn cứ áp dụng BPKCTT cấm chuyển dịch quyền về tài sản đối với tài sản đang tranh chấp là cần thiết. Trong nội dung bài viết, tác giả trình bày những vấn đề cơ bản của pháp luật liên quan đến căn cứ áp dụng biện pháp này, trình bày và phân tích thực tiễn áp dụng pháp luật tại một số Tòa án, một số bất cập và kiến nghị hoàn thiện quy định pháp luật.
