Bồi thường, hỗ trợ, tái định cư khi Nhà nước thu hồi đất là một trong những vấn đề quan trọng trong quản lý nhà nước về đất đai, có ảnh hưởng trực tiếp đến quyền và lợi ích hợp pháp của người sử dụng đất có đất bị thu hồi. Hiến pháp năm 2013 và Luật Đất đai 2013 đã có những nội dung đổi mới nhằm phân bổ hợp lý, khai thác tiết kiệm, hiệu quả nguồn lực đất đai, bảo đảm hài hòa lợi ích giữa Nhà nước, người dân và doanh nghiệp. Luật Đất đai 2013 đã quy định 33 điều về thu hồi đất, bồi thường, hỗ trợ, tái định cư (Chương VI). Ngay sau đó, Chính phủ đã ban hành các văn bản quy định chi tiết về thu hồi đất, bồi thường, hỗ trợ, tái định cư. Nhà nước sẽ thu hồi đất vì mục đích quốc phòng, an ninh
phát triển kinh tế - xã hội vì lợi ích quốc gia, công cộng trên nguyên tắc công khai, minh bạch, dân chủ. Bài báo tập trung phân tích những định hướng về đổi mới, hoàn thiện cơ chế, chính sách thu hồi đất, bồi thường, hỗ trợ, tái định cư trong Nghị quyết 19/NQ-TW và các quy định pháp luật về chính sách bồi thường, hỗ trợ, tái định cư khi Nhà nước thu hồi đất trên cơ sở Luật Đất đai năm 2013.Compensation, support, and resettlement when the State acquires land is one of the important issues in state management of land, directly affecting the legal rights and interests of land users. The 2013 Constitution and the 2013 Land Law have innovative content to rationally allocate, economically and effectively exploit land resources, ensuring harmony of interests between the State, people and businesses. The 2013 Land Law stipulates 33 articles on land recovery, compensation, support and resettlement (
- Chapter VI). Immediately, the Government issued documents detailing land acquisition, compensation, resettlement and livelihood support. The State acquires land for defense and security purposes
socio-economic development for national and public interests on the principles of openness, transparency and democracy. The article focuses on analyzing directions for innovating and perfecting mechanisms and policies on land acquisition, compensation, resettlement and livelihood support in Resolution 19/NQ-TW and legal regulations on compensation policies.
