Distribution of inheritance under wills is an activity performed by an authorized or competent subject based on certain principles in accordance with the legal grounds for estate distribution prescribed by the law. At the same time, it establishs ownership upon the inherited estate after all property-related obligations have been fulfilled, ends the situation where many heirs have the same right to enjoy the inheritance right upon one or more properties left by the deceased. The article focuses on analyzing current legal provisions on distribution of estate under wills in some special cases
thereby, proposes some recommendations to improve the law on this issue.Phân chia di sản thừa kế theo di chúc là hoạt động do chủ thể được trao quyền hoặc có thẩm quyền thực hiện theo các nguyên tắc nhất định, phù hợp với căn cứ phân chia mà pháp luật quy định, đồng thời nhằm xác lập quyền sở hữu đối với di sản thừa kế sau khi đã thực hiện nghĩa vụ tài sản từ di sản, chấm dứt tình trạng nhiều người cùng có quyền được hưởng di sản từ một hoặc nhiều tài sản do người chết để lại.
