Theo quy định của Luật Sở hữu trí tuệ (Luật SHTT), quyền sở hữu trí tuệ là quyền của tổ chức, cá nhân đôĩ với tài sản trí tuệ, bao gồm quỳên tác giả và quyền liên quan đến quyền tác giả, quyền sở hữu công nghiệp và quỳên đôì với giông cây trong. Qua hơn 16 năm thực hiệnm, Luật SHTT đã phát huy hiệu quả to lớn trong thực tiễn, tạo hành lang pháp lý hữu hiệu trong việc xác lập, bảo hộ quỳên tác giả, quyền liên quan, quyền sở hữu công nghiệp, quỳên đối với giôhg cây trồng của các tổ chức, cá nhân trong và ngoài nước. Tuy nhiên, quá trĩnh thực thi Luật SHTT thời gian qua cũng cho thấy một sô'quy định của Luật đang bộc lộ những hạn chế, bất cập so với yêu cầu thực tiễn. Bên cạnh đó, Việt Nam đang trong giai đoạn phát triển nhanh chóng vê công nghiệp và đẩy mạnh hội nhập quốc tế, nên việc tăng cường bảo hộ tài sán sở hữu trí tuệ đang trở nên cấp thiết hơn bao giờ hêì. Do vậy, việc chi ra các hạn chế trong quá trình thực hiện, từ đó sửa đổi, bổ sung Luật SHTT là đòi hỏi cấp bách trong giai đoạn hiện nay., Tóm tắt tiếng anh, According to the provisions of the Intellectual Property Law (IP Law), intellectual property rights are the rights of organizations and individuals to intellectual property, including copyright and copyright-related rights, industrial property rights and rights to plant varieties. However, the recent implementation of the IP Law also shows that some provisions of the Law are revealing limitations and inadequacies compared to practical requirements. Besides, Vietnam is in the period of rapid industrial development and international integration, so the strengthening of intellectual property protection is becoming more urgent than ever. Therefore, pointing out the limitations in the implementation process, thereby amending and supplementing the IP Law is an urgent requirement in the current period.
