Các quy định về giấy phép môi trường là nhóm quy định mới của Luật Bảo vệ môi trường 2020, nhằm tạo ra sự thống nhất và giảm bớt các thủ tục hành chính và chi phí, tạo điều kiện hơn cho các nhà đầu tư trong hoạt động sản xuất, kinh doanh. Bài viết này phân tích một số quy định pháp luật về đối tượng phải có giấy phép môi trường và nội dung giấy phép môi trường trong Luật Bảo vệ môi trường 2020 và các văn bản hướng dẫn thi hành. Theo đó, nhấn mạnh giấy phép môi trường là văn bản do cơ quan quản lý nhà nước có thẩm quyền cấp cho tổ chức, cá nhân có hoạt động sản xuất, kinh doanh, dịch vụ được phép xả chất thải ra môi trường, quản lý chất thải, nhập khẩu phế liệu từ nước ngoài làm nguyên liệu sản xuất kèm theo yêu cầu, điều kiện về bảo vệ môi trường theo quy định của pháp luật.Regulations on environmental permits are a new group of regulations of the Law on Environmental Protection 2020. These regulations are to create unity, reduce administrative procedures and costs, and create more favorable conditions for investors to do business. This paper analyzed some legal regulations on subjects required to have environmental permits and the content of environmental permits in the Law on Environmental Protection 2020 and its guiding documents. Accordingly, it is emphasized that an environmental permit is a document issued by a competent state management agency to organizations and individuals that conduct business activities. It allows the permit-holder to discharge waste into the environment, manage waste, and import scrap from abroad as raw materials for production with requirements and conditions on envừonmental protection according to the provisions of law.
