Chế định thế chấp tài sản được quy định trong văn bản quy phạm pháp luật từ rất lâu và đã được hoàn thiện dần qua các thời kỳ. Tuy nhiên, qua thực tế áp dụng, vấn đề này cũng đã bộc lộ rõ nhiều bất cập, vướng mắc, gây khó khăn cho các chủ thể tham gia giao dịch. Trên cơ sở những vấn đề về lý luận và thực tiễn cũng như tầm quan trọng của hình thức bảo đảm này trong xã hội, tác giả đã kiến nghị một số nội dung nhằm hoàn thiện pháp luật liên quan đến thế chấp tài sản, bảo đảm hành lang pháp lý an toàn cho các bên, nhất là bên có quyền.The institution of property mortgages has been regulated in legal documents for a long time and has been gradually improved over time. However, through practical application, regulations on property mortgages still have many inadequacies and obstacles, causing difficulties for related subjects. Based on theoretical and practical issues as well as the importance of property mortgages, this paper presented recommendations to improve regulations on property mortgages, ensuring a safe legal corridor for all parties, especially rights holders.
