The establishment of a legal framework for early intervention mechanisms in commercial banks is essential for timely addressing risks and weaknesses, thereby preventing systemic collapse. This issue is increasingly garnering attention from various countries, including Vietnam. Through the synthesis and analysis of both domestic and international documents, particularly Vietnam's regulatory framework concerning early intervention mechanisms for commercial banks, this article evaluates the current legal status of early intervention as outlined in Law on Credit Institutions in 2024. The evaluation focuses on: (1) Situations where early intervention is applicable to commercial banks
(2) Authorities responsible for early intervention
(3) Procedures and processes for implementing early intervention
(4) Measures for early intervention. Based on this evaluation, the article offers several observations regarding regulations on authority, applicable situations, sanctions for involved parties, and the role of deposit insurance in the early intervention process, aiming to enhance legal regulations and improve practical enforcement effectiveness.Việc thiết lập khung pháp lý về cơ chế can thiệp sớm đối với ngân hàng thương mại nhằm xử lý kịp thời những rủi ro, yếu kém và ngăn chặn sự sụp đổ của hệ thống là rất cần thiết và ngày càng được các quốc gia trong đó có Việt Nam quan tâm xây dựng. Trên cơ sở tổng hợp, phân tích tài liệu trong và ngoài nước, đặc biệt là hệ thống quy định của Việt Nam về cơ chế can thiệp sớm đối với ngân hàng thương mại, bài viết đánh giá thực trạng pháp luật hiện hành về can thiệp sớm đối với ngân hàng thương mại trong Luật Các tổ chức tín dụng năm 2024. Các khía cạnh đánh giá gồm: (1) Các trường hợp ngân hàng thương mại bị áp dụng can thiệp sớm
(2) Thẩm quyền can thiệp sớm
(3) Trình tự, thủ tục can thiệp sớm
(4) Các biện pháp can thiệp sớm. Từ đó, bài viết đưa ra một số bình luận liên quan đến qui định về thẩm quyền, trường hợp áp dụng, chế tài đối với các bên và sự tham gia của tổ chức bảo hiểm tiền gửi vào quá trình can thiệp sớm nhằm tiếp tục hoàn thiện các quy định pháp luật và nâng cao hiệu quả thực thi trên thực tế.
