Luật Đất đai năm 2013 và các văn bản hướng dẫn sau hơn 4 năm thi hành, bên cạnh những kết quả đạt được vẫn còn tồn tại bất cập ở một số quy định về quy hoạch, kế hoạch sử dụng đất. Trong bối cảnh Luật Quy hoạch năm 2017 sắp có hiệu lực thi hành từ ngày 01/01/2019, đặt ra yêu cầu cấp thiết cần phải rà soát, nghiên cứu sửa đổi, bổ sung các quy định về quy hoạch, kế hoạch sử dụng đất nhằm thống nhất và đồng bộ với các quy định về các loại quy hoạch khác. Bài viết phân tích, đánh giá một số hạn chế, bất cập của quy định pháp luật về quy hoạch, kế hoạch sử dụng đất và đề xuất giải pháp nhằm hoàn thiện các quy định đó sao cho đảm bảo tính thống nhất, phù hợp với Luật Quy hoạch năm 2017.The 2013 Land Law and its guiding documents after more than 4 years of implementation, besides the achieved results, still exist inadequacies in some regulations on land use planning and plans. In the context that the 2017 Planning Law is about to take effect from January 1, 2019, there is an urgent need to review, study, amend and supplement the regulations on planning and plans on use land in order to be consistent and synchronized with regulations on other types of planning. The paper analyzes and assesses some limitations and inadequacies of the law on land use planning and plans and proposes solutions to perfect those regulations to ensure consistency and suitability with the Planning Law of 2017.
