Người đại diện theo ủy quyền của đương sự trong Tố tụng dân sự ngày càng có vị trí quan trọng trong việc thay mặt đương sự bảo vệ quyền và lợi ích hợp pháp của đương sự. Thực tiễn xét xử trong thời gian gần đây cho thấy, số lượng vụ án dân sự có người đại diện theo ủy quyền của đương sự, đặc biệt là luật sư tham gia tố tụng ngày càng cao hơn. Những người đại diện có kiến thức pháp luật nhất định như luật sư sẽ bảo vệ được quyền và lợi ích hợp pháp cho đương sự, đồng thời cũng tránh được những thiếu sót trong hoạt động tố tụng và làm cho quá trình tố tụng được nhanh gọn hơn. Thực tiễn cho thấy, việc luật sư tham gia tố tụng với tư cách là đại diện theo ủy quyền của đương sự là phổ biến và đạt được những hiệu quả nhất định, họ chủ động và phát huy tốt vai trò cũng như trách nhiệm của mình trong công việc ủy quyền. Tuy vậy, việc tham gia tố tụng của người đại diện theo ủy quyền trên thực tế vẫn còn rất nhiều khó khăn, vướng mắc và hạn chế. Bài viết phân tích một số vướng mắc, tồn tại trong thực tiễn thực hiện quy định về người đại diện theo ủy quyền của đương sự trong Tố tụng dân sự Việt Nam hiện hành.The litigant's authorized representative in Civil Procedure has become an increasingly important position in protecting the parties' legitimate rights and interests. Recent trial practice shows that the number of civil cases with authorized representatives of the litigants, especially lawyers participating in the proceedings, is increasing. Representatives with certain legal knowledge, such as lawyers, will protect the lawful rights and interests of the litigants, at the same time avoid shortcomings in legal proceedings and speed up the procedure. more compact. In practice, it is common for lawyers to participate in the proceedings as authorized representatives of the litigants and achieve certain effects, they are proactive and promote their roles and responsibilities well in proxy work. However, participating in the proceedings of the authorized representative in reality still faces many difficulties, obstacles and limitations. The paper analyzes some problems and shortcomings in reality of implementing current regulations on authorized representatives of litigants in Vietnam Civil Procedure.
